明慧網舉報迫害法輪功者至美移民局 律師:意義重大
【真相網2019.10.2】「法輪大法明慧網」近日發表文章,呼籲各界民眾,提供已經進入美國的參與迫害法輪功學員的人員名單。「明慧網」會將名單,遞交給美國移民與海關執法局,要求將這些人抓捕遣返。美國資深律師認為,此舉意義重大。
法輪功將向美移民局提供在美惡人名單
【明慧網二零一九年九月十日】近日,美國移民與海關執法局(ICE,Immigration and Customs Enforcement)通過在紐約、舊金山、亞特蘭大、洛杉磯等十二個城市的辦公室在全國範圍內展開統一的「絕無藏匿之地」(No Safe Haven)行動,逮捕了三十九名在美國境內居住的涉嫌侵犯人權的外國人,其中包括四名涉及強制節育的中國人。這些人將被遣返回母國。
此前明慧已發布收集嚴重迫害法輪功學員的惡人名單《通告》,側重於限制惡人入境美國,現在需要收集已經進入美國的惡人的名單。
如果有參與迫害法輪功的個人已經或即將在美國長期居住,包括合法和非法移民、較長時間的探親訪友等,希望法輪功學員和各界民眾向明慧網舉報,法輪功學員會將名單遞交美國移民與海關執法局、要求將其抓獲並驅逐出境。收集的名單包括曾在中國大陸和其它國家(尤其是美國)對法輪功學員施暴的惡人。
美國長期以來對犯下反人類罪的人權侵犯者有各種制裁措施,包括驅逐出境。最典型的例子之一,二戰結束幾十年後,仍然將包括當年集中營看守在內的納粹罪犯驅逐出境。根據美國的立國原則,在世界任何地方犯下反人類罪行並試圖到美國來逃避懲罰的人權迫害者都要對犯下的罪行承擔責任。根據這一原則,美國移民與海關執法局於二零零八年成立了「人權迫害者及戰爭犯罪中心」(The Human Rights Violators and War Crimes Center,HRVWCC),專門針對境內居民進行人權迫害方面的調查,以免美國成為人權迫害者的避風港。調查的方面包含:
- 迫害
- 戰爭犯罪
- 群體滅絕
- 酷刑
- 法外殺戮
- 對宗教自由的嚴重侵犯
- 等等。
鑒於人權迫害者在美國躲避懲罰不僅違反了美國法律,而且他們通常對美國懷有敵意,構成了對美國國家安全的威脅,「人權迫害者及戰爭犯罪中心」從二零一四年開始了「絕無藏匿之地」行動(No Safe Haven Operation),對確認及涉嫌的人權迫害者和戰爭罪犯依法實施逮捕、起訴乃至遞解出境。該行動自二零一四年開始,已進行五次。
近年來,美國政府對中國人權迫害者的制裁,從立法到執法都有明顯的加強。「人權迫害者及戰爭罪犯中心」與國際法庭、各國執法機構和國際刑警組織合作識別罪犯。非政府組織在協助尋找和支持證人方面起著至關重要的作用。美國政府官員在解釋如何使用現有法律制裁人權迫害者時,甚至明確告訴包括法輪功在內的受迫害團體:「我們需要你們的幫助,需要你們為我們提供線索。」
我們現在收集現居美國的、曾經在中國大陸及其它國家(尤其是美國)以各種形式參與迫害法輪功並導致較嚴重後果的惡人名單。我們將彙集惡人名單並遞交給美國移民局,要求將其拘捕並遞解出境。
對於現居美國、曾在中國大陸行惡的人,可舉報的惡行包括(但不限於):
- 酷刑、暴打、電擊、殺戮(包括命令者、實施者)
- 司法系統非法對法輪功學員判刑或勞教導致其後來被酷刑、殺戮等(包括公檢法人員)
- 提供情報導致拘捕、酷刑及殺戮(包括舉報無辜的法輪功學員的單位負責人、同事、同學、鄰居、路人)
對於現居美國、曾在美國及其它國家參與迫害的人,可舉報其嚴重侵犯信仰自由的惡行,包括(但不限於):
- 在真相點侮辱、謾罵、毆打法輪功學員,搶奪、損壞學員的物品
- 在神韻演出現場侮辱、謾罵法輪功學員

Falun Gong Practitioners to Submit List of Human Rights Violators to U.S. Immigration Services September 11, 2019 | By Falun Gong practitioners in the United States (Minghui.org) The U.S. Immigration and Customs Enforcement (ICE) recently arrested 39 fugitives who are documented human rights violators and now live in the U.S. This operation, known as No Safe Haven, was conducted in collaboration with 12 local ICE offices, including New York, San Francisco, Atlanta, Los Angeles and others. All 39 individuals, including four from China involved in forced abortions and sterilizations against victims, will be repatriated to their countries of origin. A Minghui.org editorial published earlier this year called for submission of information on perpetrators involved in the persecution of Falun Gong so as to bar their entry to the U.S. In response to the call for action, we, a group of Falun Gong practitioners in the U.S., submitted a list of perpetrators to the U.S. Department of State in July. Given the latest ICE No Safe Haven operation, we hereby ask those with knowledge of the persecution of Falun Gong to collect information on individuals now living in the U.S. who have either directly abused or collaborated in violating the human rights of Falun Gong practitioners both inside and outside of China. These individuals may include legal and illegal immigrants, as well as those on visitors' visas. We hope that our fellow practitioners and non-practitioners who may know anything about these perpetrators will report them. We will then submit a list of names to ICE for the agency to take appropriate action. HRVWCC and No Safe Haven Initiative For a long time, the U.S. government has issued many types of sanctions, including deportation, against human rights violators who have committed crimes against humanity. Concentration camp guards and other Nazi criminals have been deported even decades after World War II ended. According to the U.S. founding principles, any human rights violator who has committed crimes against humanity, anywhere in the world, and who attempts to escape punishment by staying in the U.S. will not escape responsibility for their crimes. The Human Rights Violators and War Crimes Center (HRVWCC) was created in 2008 to investigate such individuals living in the U.S., to prevent the United States from becoming a safe haven for human rights violators. According to the ICE website, HRVWCC carries out investigations focused on human rights violations in the following areas: PersecutionWar crimesGenocideTortureExtrajudicial killingsSevere violations of religious freedomand others When explaining the function of Homeland Security Investigations (HSI) and the mission of the No Safe Haven Initiative, the ICE website states, 「They [these individuals] may be former officials of regimes that are or were potentially hostile to our nation and its interests, making them not only human-rights violators, but also national security threats. HSI's No Safe Haven Initiative targets these individuals.」 The first No Safe Haven operation took place in 2014, and the recent arrests of the 39 fugitives mentioned above was the fifth operation, also referred to as Operation No Safe Haven V. The operation includes arrest, conviction, and deportation of war criminals and human rights abusers. Sanctions against human rights violators, including those from China, have been intensified in recent years, from legislation to law enforcement. HRVWCC has also been collaborating with international courts, foreign law enforcement agencies, and Interpol to identify and locate perpetrators. Non-governmental organizations (NGOs) have played a critical role in finding witnesses. When explaining how to pursue human rights violators with legal measures, a U.S. government officer told a number of persecuted groups, including Falun Gong practitioners, that their help is needed – especially in providing investigation leads. Collecting Information We are calling for information on individuals who currently live in the U.S. and have participated in the persecution of Falun Gong, regardless of whether the acts of aggression were in China or other countries (especially in the U.S.). Our focus is on perpetrators who have caused severe consequences. A list of names will be submitted to the U.S. Immigration Services, which may then take appropriate action as required by law. For those currently residing in the U.S. who have committed human rights violations in China, the information to be gathered includes (but is not limited to): The nature of the crime, whether torture, beating, electric shocking, and killing (both issuing and executing orders) of Falun Gong practitioners. The agency they operated within: Justice System (Police, Procuratorate), including the courts involved in practitioners』 imprisonment and labor camp detentions that resulted in torture and death. Information on individuals who provided information to Chinese officials that caused the practitioners』 arrest, torture, and death. This can be practitioners』 workplace officials, coworkers, classmates, neighbors, and members of the public. For those who currently reside in the U.S. with crimes committed outside China (including the U.S.), requested information includes, but is not limited to, the following: Acts of humiliation, including verbal abuse, striking Falun Gong practitioners, or seizing or damaging personal belongings at places such as tourist sites. Acts of humiliation and verbal abuse of Falun Gong practitioners at venues where Shen Yun was performing.
